Fishak Labs

Terms of Service

These Terms of Service ("Terms") govern access to and use of Auto-Trade, an automated trading product operated by Fishak Labs, a sole proprietorship registered in India ("Fishak Labs", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Auto-Trade runs automated trading strategies against an exchange or broker account that you connect yourself. We never take custody of your funds. Your exchange/broker account remains yours at all times; the Service only submits orders to it, sized within the capital cap and guards you configure. You can revoke the Service's API access from your exchange/broker at any time, independent of your Fishak Labs subscription.

2. Accounts

You must provide accurate information when creating an account and are responsible for keeping your credentials and two-factor authentication secure. You must be at least 18 years old and legally able to enter contracts to use the Service.

3. Subscriptions and billing

This section covers the bot capital-tier subscriptions described in the bot console. Paid tiers are billed for a one-week period at a time, at the price shown for the capital cap you select at checkout. Live trading for a given tier runs until the end of the period you paid for; continuing into the next period requires completing a new checkout before the current period ends. Billing for these tiers is not currently automatic — we do not charge you again without your action.

If a period ends without a new checkout, or you stop before it renews, nothing is force-closed: the bot stops opening new positions and finishes winding down any position it already holds (a close-only wind-down). Once flat, it automatically drops to free forward/practice mode, where it keeps running with no live capital at risk and no charge, for as long as you like.

Other paid features of the Service, where offered, may bill on different terms (including an auto-renewing cycle) — those terms are disclosed to you at the time you subscribe to that feature.

See our Refund and Cancellation Policy for refund eligibility.

4. Acceptable use

You agree not to: use the Service for money laundering or to trade with funds you are not legally entitled to; attempt to circumvent the capital caps or guards enforced by the Service; reverse-engineer, resell, or provide unauthorized third-party access to the Service; or use the Service in a manner that violates the law of your jurisdiction or the exchange/broker's own terms.

5. Geographic restrictions

The Service is available globally by design, with one exception: it may not be accessed from, or used by a person or entity located in, a jurisdiction subject to comprehensive sanctions administered by the U.S. Office of Foreign Assets Control (OFAC), currently including North Korea, Iran, Cuba, Syria, and the Crimea region of Ukraine. You represent that you are not located in, and not a resident of, any such jurisdiction.

6. Risk

Trading carries real risk of loss. Read the Risk and Trading Disclosure before enabling live trading — it is incorporated into these Terms by reference.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Fishak Labs' aggregate liability arising out of or related to the Service is limited to the fees you paid us in the three months preceding the claim. Fishak Labs is not liable for indirect, incidental, consequential, or punitive damages, or for losses arising from market conditions, exchange outages, broker errors, or your own configuration choices.

8. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for violation of these Terms, suspected fraud, or a sanctions-jurisdiction match under Section 5, with notice where practicable.

9. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996, seated in India, in English. This does not preclude either party from seeking injunctive relief in a court of competent jurisdiction where arbitration would not provide an adequate remedy.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email before they take effect. Continued use of the Service after a change takes effect constitutes acceptance.
